Welcome to the Intelligenciia website. These terms of use govern your use of and access to this website and are binding upon you.

Please review these terms carefully: your access to and use of this site constitutes your consent to be bound by these terms.

These terms may be updated from time to time. You can access older versions by contacting us at hello@intelligenciia.com with the subject line “Terms”.

Licence

Subject to your compliance with these terms, Intelligenciia grants you access to and use of this website. Any documents available for download from this website are for your own personal use only. You agree not to use any content, information and materials on the website for any other reason except as set out in these terms.

All trademarks, trade names and logos displayed on this website are the exclusive property of Intelligenciia or their third-party owners, and you are not granted any rights to these trademarks, trade names or logos.

Uploaded documents

Intelligenciia provides talent procurement and retention services. As part of these services, users may upload résumés and other employment documents (“Uploaded Documents”). While these Uploaded Documents belong to the users who uploaded them, Intelligenciia may provide Uploaded Documents to the employers whose positions you are applying for. We may also provide those employers with the answers to questions you will be asked or have been asked during the job application process.

If a prospective employer thinks you are a good fit, we will provide you with a Candidate Representation form. Once we have a signed Candidate Representation form, we may present more information about you to the prospective employer.

Any comments you make on our website’s forums, message boards, or through our website’s messaging platform form part of your Uploaded Documents. You acknowledge that these comments are not confidential, are gratuitous, and do not place Intelligenciia under any fiduciary or other obligation to you or to any other person. Intelligenciia may use anonymized versions of answers to questions you were asked during a job application process for our own purposes.

For example, if we ask you what your current salary is, we may take the answer to that question and provide it to a prospective employer as part of a data set including answers from other candidates to help them decide what to pay for a certain role. In doing so, we will not provide the employer with your name or other information about you without your explicit consent.

You represent and warrant that your Uploaded Documents are complete and accurate, and are not fraudulent, tortious or otherwise in violation of any applicable law or any right of any third party, including intellectual property rights. You agree to maintain and update Uploaded Documents so that they remain accurate. Intelligenciia may screen your Uploaded Documents and may remove Uploaded Documents from the website for any reason.

We may also use the Uploaded Documents for the purposes described in our Privacy Policy, and we may disclose information from the Uploaded Documents to third parties for the purposes and in the circumstances described in the Privacy Policy. The Privacy Policy governs how we may collect, use and disclose information that we may collect about you through your use of the site or as a result of that use.

User conduct

You agree not to use or make available on the website any material which might be:

• Threatening, degrading, intimidating or harassing;
• Defamatory, fraudulent or tortious;
• Obscene or indecent; or
• Otherwise protected by a third party’s right of publicity or property, or any other proprietary right, without their express consent.

You agree not to use the website for your own commercial purposes, or in any manner which violates the laws of Canada or your respective jurisdiction.

You agree not to collect any information about other users on the website or restrict any other user’s access to the site, and you agree not to download or store any site content that is not explicitly labelled as available for download.

You agree not to post, transmit or make available through the website anything that is potentially harmful, invasive or designed to damage hardware or software.

Legal

By using this site, you agree and confirm that you are at least 18 years or older. If you are accessing our site on behalf of a corporation or any other legal entity you are associated with, you confirm that you have the legal authority to bind the given legal entity to these terms. This website is controlled and operated from Canada, and it is not our intention to subject Intelligenciia to laws from jurisdictions other than Canada, and in particular, British Columbia.

These terms (i) shall be governed by and construed in accordance with the laws of the Province of British Columbia, and (ii) may be amended only by written agreement executed by the authorized representatives of each party.

You agree to indemnify, defend, and hold harmless Intelligenciia and its affiliates, officers, directors and agents from any liabilities or loss which arise out of your access or use of the website, or your violation of these terms or our Privacy Policy.

This site is provided on an “as is” and “as available” basis, and Intelligenciia disclaims all warranties with respect to the website, to the extent permitted by law. Intelligenciia shall not be liable for indirect, special, incidental or consequential damage or damages for loss of goodwill or profits arising directly or indirectly from the use of the website.

Intelligenciia may terminate or suspend a user’s access to the website at any time, with or without cause, including if you have violated or acted in a manner which is inconsistent with these terms.

Further, and without limiting the foregoing, Intelligenciia does not guarantee that any user will receive any employment or hiring opportunities through the website.
